By accessing or using Forem Software (a subsidiary of Forem Innovations Private Limited) products and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Forem Software provides various software products and services including but not limited to 4MCart, Recruit Bright, Forem Meet, Forem News, Forem Tasks, Forem Notes, and Forem Weather. We reserve the right to modify, suspend, or discontinue any part of our Services at any time.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use our Services for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit malware, viruses, or harmful code

7. Data Protection and Privacy

Your personal data is processed in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 and Digital Personal Data Protection Rules, 2025. For the purposes of these laws, Forem Software acts as a Data Fiduciary and you are a Data Principal. By using our Services you acknowledge that:

• We process your personal data only for specified, lawful purposes and on the basis of your consent or a permitted legitimate use
• You may access, correct, or erase your personal data, nominate another person to exercise your rights, and withdraw your consent at any time — withdrawal is as easy as giving consent
• Where you are under 18, or are a person with a disability with a lawful guardian, we require verifiable parental or guardian consent before processing your data
• You may raise a data-related grievance with our Grievance Officer and, if unresolved, escalate it to the Data Protection Board of India

The Privacy Policy forms an integral part of these Terms.

8. Payment and Billing

For paid Services:

• You agree to pay all fees associated with your subscription
• Fees are billed in advance on a recurring basis
• You authorize us to charge your payment method automatically
• Refunds are subject to our refund policy

9. Disclaimer of Warranties

Our Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Forem Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.

11. Indemnification

You agree to indemnify and hold harmless Forem Software from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

12. Termination

We may terminate or suspend your access to our Services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on our website. Your continued use of our Services after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

Forem Innovations Private Limited, the parent company of Forem Software, operates in full compliance with:

• Digital Personal Data Protection Act, 2023
• Digital Personal Data Protection Rules, 2025 - notified on 13 November 2025
• Information Technology Act, 2000 and its amendments
• IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
• Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
• Companies Act, 2013 - Registered as a Private Limited Company in India

16. Grievance Redressal Mechanism

In compliance with IT Rules 2021, we have established a comprehensive grievance redressal mechanism:

• Submit grievances through our Online Grievance Form
• Track complaint status via our Complaint Status Portal
• Grievances are acknowledged within 24 hours
• Resolution provided within 15 days as per regulatory requirements
